I.  Respondent Parent Counsel Checklist for Permanency Planning Hearing




If there has been no finding the child is an Indian child:
  • If notice was sent before dispositional hearing, but there was no response at the time of that hearing, follow up to see if any tribe has responded.
  • If the parent has not returned the ICWA form, continue to encourage the parent to return the form.
  • Ensure all information provided by your client is made available to the caseworker/department.

If the child has been found to be an Indian child and tribe has intervened:

  • Ensure proper notice of the hearing has been sent to the tribe.

If there has been a finding the child is not an Indian child:

  • Check that no new information has surfaced that would bring this finding into doubt or would trigger the need to send notice.
