H.  Department Checklist for Permanency Planning Hearing




If there has been no finding the child is an Indian child:
  • If notice was sent before dispositional hearing, but there was no response at the time of that hearing, follow up to see if any tribe has responded.
  • If the parent has not returned the ICWA form, continue to attempt to secure the form’s return and take appropriate action if the form is returned.

If the child has been found to be an Indian child and tribe has intervened:

  • Ensure proper notice of the hearing has been sent to the tribe.
If there has been a finding the child is not an Indian child:
  • Check that no new information has surfaced that would bring this finding into doubt or would trigger the need to send notice.
