G.  Permanency Planning Hearing




If there has been no finding the child is an Indian child:
  • If notice was sent before dispositional hearing, but there was no response at the time of that hearing, follow up to see if any tribe has responded.
  • If a tribe or tribe has responded, make appropriate findings.
  • If the parent had not returned the ICWA form, order the parent to do so.

If the child has been found to be an Indian child and tribe has intervened:

  • Ensure proper notice of the hearing has been sent to the tribe.

If there has been a finding the child is not an Indian child:

  • heck that no new information has surfaced that would bring this finding into doubt or would trigger the need to send notice.
