The following persons have standing to raise ICWA violations.
  • The Indian child subject to any action for foster care placement or termination of parental rights;
  • Any parent, including a biological, but non-Indian, parent;
  • An Indian custodian from whose custody the child was removed;
  • The child’s tribe.
