The county attorney, special county attorney, or a city attorney of a city and county represents the People of the State of Colorado to prosecute the D&N petition.

“Special county attorneys” may be appointed for these cases. County attorneys hire special county attorneys to handle D&N cases. DHS may also hire them if the county agrees.

A district attorney may not act as a special county attorney because of the potential conflict of related criminal proceedings.
